美国对中国普通合金铝板产品双反立案阶段要点摘要！

此案由美国商务部（DOC）自主发起（未经美国国内产业申请程序）。DOC在立案公告中称，中国普通合金铝板产品自2005年以来大量进口到美国，并在过去三年内快速增长，加之中国铝行业整体上存在的严重产能过剩在近期美国国际贸易委员会（U.S.ITC）的相关调查中已经被证实，因此美国国内产业正面临中国出口进一步增长的可能性。

调查期：

补贴调查期：2016年1月1日-12月31日（一年）

The merchandise covered by these investigations is common alloyaluminum sheet, which is a flat-rolled aluminum product having a thickness of6.3 mm or less, but greater than 0.2 mm, in coils or cut-to-length, regardlessof width. Common alloy aluminum sheet within the scope of these investigationsincludes both not clad aluminum sheet, as well as multi-alloy, clad aluminumsheet.

被调查产品是普通合金铝板/卷，厚度在0.2毫米（不含）至6.3毫米（含）之间的平卷，成卷状或以定尺板形式，无论产品的宽度。被调查产品为非复合铝板和非多合金复合铝板。

With respect to not clad aluminum sheet, common alloy sheet ismanufactured from a 1XXX-, 3XXX-, or 5XXX-series alloy as designated by theAluminum Association. With respect to multi-alloy, clad aluminum sheet, commonalloy sheet is produced from a 3XXX-series core, to which cladding layers areapplied to either one or both sides of the core.

非复合铝板，即普通合金铝板一般由1XXX-, 3XXX-, or 5XXX系列铝生产而成。多合金铝板和复合铝板一般由3XXX-系列铝生产的中间层，然后在一面或双面加附一层金属覆膜（层）。

Common alloy sheet may be made to ASTM specification B209-14, butcan also be made to other specifications. Regardless of specification, however,all common alloy sheet meeting the scope description is included in the scope.Subject merchandise includes common alloy sheet that has been further processedin a third country, including but not limited to annealing, tempering,painting, varnishing, trimming, cutting, punching, and/or slitting, or anyother processing that would not otherwise remove the merchandise from the scopeof the investigations if performed in the country of manufacture of the commonalloy sheet.

普通合金铝板一般按照美国ASTM的B209-14标准生产，但也可能按照其他标准生产。无论生产标准如何，所有的普通合金铝板都在本次被调查范围之内。（原产于中国，但）在第三国进行了（简单）深加工的普通合金铝板，如在第三国进行热处理、回火处理、喷涂、上漆、修整、裁切、打孔和/或切口加工后的产品，仍属于被调查产品（译注：即仍是原产于中国的涉案产品）；这些（简单）深加工活动不限于上述列举的几种加工，其它加工行为也算，除非该深加工行为导致普通合金铝板成为另一个产品，使之从“被调查产品”变为“非被调查产品”（译注：如把铝板加工成机器配件等，导致其不再是铝板）。

Excluded from the scope of these investigations is aluminum canstock, which is suitable for use in the manufacture of aluminum beverage cans,lids of such cans, or tabs used to open such cans. Aluminum can stock isproduced to gauges that range from 0.200 mm to 0.292 mm, and has an H-19, H-41,H-48, or H-391 temper. In addition, aluminum can stock has a lubricant appliedto the flat surfaces of the can stock to facilitate its movement throughmachines used in the manufacture of beverage cans. Aluminum can stock isproperly classified under Harmonized Tariff Schedule of the United States(HTSUS) subheadings 7606.12.3045 and 7606.12.3055.

排除在被调查产品范围的的是制罐用铝板，制罐用铝板一般用来生产铝制饮料易拉罐、罐盖或拉环。制罐用铝板的厚度一般为0.2毫米到0.292毫米，回火为H-19,H-41, H-48或H-391。另外，铝罐料在表面上一般涂有一层润滑油，使得铝板能平滑地通过机器。铝罐料的美国关税号为7606.12.3045和7606.12.3055。

Where the nominal and actual measurements vary, a product is withinthe scope if application of either the nominal or actual measurement wouldplace it within the scope based on the definitions set for the above.

产品的名义尺寸或实际尺寸可能有不同，但两个尺寸中任何一个落入以上范围内即是被调查产品。

Common alloy sheet is currently classifiable under HTSUS subheadings7606.11.3060, 7606.11.6000, 7606.12.3090, 7606.12.6000, 7606.91.3090,7606.91.6080, 7606.92.3090, and 7606.92.6080. Further, merchandise that fallswithin the scope of these investigations may also be entered into the UnitedStates under HTSUS subheadings 7606.11.3030, 7606.12.3030, 7606.91.3060,7606.91.6040, 7606.92.3060, 7606.92.6040, 7607.11.9090. Although the HTSUSsubheadings are provided for convenience and customs purposes, the writtendescription of the scope of these investigations is dispositive.

普通合金铝板现在的海关税号是7606.11.3060, 7606.11.6000, 7606.12.3090, 7606.12.6000,7606.91.3090, 7606.91.6080, 7606.92.3090,和7606.92.6080。但是被调查产品有时也会在以下海关税号下进口：7606.11.3030, 7606.12.3030, 7606.91.3060, 7606.91.6040,7606.92.3060, 7606.92.6040, 7607.11.9090。

注意：海关税号只是为了提供方便，文字的描述才是区分调查产品或非被调查产品的准则。

替代国选择理由：

南非是与中国经济发展水平相当的市场经济国家，有着可比较产品的生产商，可获取用于评估生产要素的公开信息。

根据美国反倾销法律规定，在预定初裁日30天之前各利害关系方均可提交有关替代国和替代价格的相关信息或评议。

主要生产要素替代价格确定方法：

DOC立案公告中称，其进行倾销幅度初步测试时使用的“生产要素”中原材料的替代价格信息来自调查期内Global Trade Atlas（GTA）上的南非从其它国家（不含从非市场经济国家、存在普遍性补贴的国家及国别不明的国家的）公开的进口价格统计数据。

天然气的替代价格采用的是南非进口液化天然气的加权平均价格。

电价采用南非公开的电价。

人工成本采用的是《南非统计》（Statistics South Africa）上公布的南非全国人工成本统计数据。

包装材料采用南非进口相关物料的价格。

制造费用、三费和利润率取自南非生产商Hulamin Ltd. 2016年合并报表的数据。

初步测试的倾销幅度：

56.54%-59.72%

反倾销数量金额（Q&V）卷答卷截止期：

2017年12月13日

反倾销分别税率申请（SRA）提交截止期：

2017年12月28日（正式立案后30天，推定日期）

反补贴调查项目：

共26个项目。

抽样：

反倾销调查程序将以出口/生产商提交的Q&V答卷为主要依据。

反补贴调查程序将根据美国海关进口数据选择强制应诉企业。

美国商务部将在立案后5天内将海关进口数据公布，利害关系方可在此之后7天内提交有关评议。

U.S. ITC损害初裁时间：

美国国际贸易委员会（U.S. ITC）将在立案后45天（2018年1月12日）内做出损害初步调查结论。
